At the same time the estranged wife of a local accountant has asked the high court to grant her part of the potential proceeds of the development.
The Daily Dispatch weekend property guide recently reported that plots worth R35m had already been paid for stands on the prime site near Beacon Bay.
Trevor Westerdale, a trustee of the MW Property Trust, which bought the Red Bishop nine-hole golf course and pub for R5,25m, now claims R1m for his interest in the trust.
But the sale of the Red Bishop property to the developers has not yet been finalised.
Westerdale is claiming the payment from the Thesen Umbrella Trust's Milton Thesen, to whom his interest in the trust was ceded.
The claim is being disputed by Thesen Umbrella Trust on the grounds that, despite claims of property sales, stands on the prime site have not been transferred.
On November 28 last year Lorna Manion, the owner of the Red Bishop, gave Westerdale or his nominee sole mandate to sell the complex for R5,25 million.
On December 12 Westerdale, on a Murray Walker Accounting & Taxation Services letterhead belonging to his business associate, signed a letter on behalf of Murray Walker to Manion and her husband to thank them "for granting us the sole mandate".
Three days later on another Murray Walker Accounting & Taxation Services letterhead, MW Properties as represented by Murray Walker personally signed an offer to purchase the property from Manion.
Walker also signed the suspensive conditions applicable to the sale of the property.
In both cases Westerdale signed as a witness.
In a subsequent deed of sale, dated April this year, MW Property Trust, represented by Tyson Walker, Murray Walker's brother, bought a property adjacent to the Red Bishop for R1m from Floradale Nursery's Gerald Muller.
This property forms part of the Bishop Country Estate development.
In a letter from Bax Kaplan Mbandazayo's Kingsley Kingon to MW Property Trust in which he enclosed the deed of sale, Kingon names Murray Walker as a reference.
Thesen's interest in the trust has been confirmed by other trustees involved with Murray Walker's business activities.
Thesen and Tyson Walker are also described as the developers of the Bishop Country Estate.
Murray Walker says he was merely a trustee of MW Property Trust and not a beneficiary.
In High Court documents filed in East London Gael Walker, wife of accountant Murray Walker of Murray Walker Accounting & Taxation Services, claims 20 percent of the assets of the MW Property Trust.
Details of the documents cannot be made public as they form part of a divorce case.
