Approved Mergers

The Competition Commission has approved has approved the following property mergers without conditions:

Intermediate merger: WHIRLPROPS 25 (PTY) LTD and YALDWYN ROAD TRUST (2003NOV712)

The merger involves Whirlprops acquiring an industrial property located in Jet Park from Yaldwyn. Whirlprops is controlled by Martprop and already own certain industrial property in the same geographic node (Gauteng East). According to International Property Databank (IPD) data, Martprop will hold a market share of 14.9% post merger in Industrial property located in the Gauteng East node.  

The Commission is of the view that Martprop’s market share is low enough not to raise any competition concern.

No significant public interest issues arise from the transaction.

The Commission accordingly concluded that it is highly unlikely that the merger would substantially prevent or lessen competition in the industrial property located in the Gauteng East node and approved the transaction without conditions.

Intermediate merger: APEXHI PROPERTIES LIMITED and ENAPLAN DEVELOPERS (PTY) LTD (2003NOV720)

ApexHi is acquiring from Enaplan the property known as the Game shopping centre in Klerksdorp. ApexHi does not have any property within its portfolio in Klerksdorp, which can be regarded as a substitutable product overlap to that of the target property.

The Commission accordingly concluded that it is highly unlikely that the merger will substantially prevent or lessen competition.

No significant public interest issues arise from the merger.

The merger was accordingly approved without conditions.
